The repurchase tax refund for buying first and then selling is according to the premise of self-use residential land at the time of land purchase.

(Taichung News) Within two years from the date of completion of the transfer registration, if the landowner repurchases self-use residential land, they may apply for a refund of the amount of land value increment tax paid that is insufficient to pay the land price for the newly purchased land. The same applies to those who purchase first and then sell.

According to the Local Tax Bureau of Taichung City Government, self-use residential land means landowners or their spouses or immediate family members own the above-ground houses. And one of them has completed the household registration in the place, and they have not rented out or used the property for business within one year before the sale. When the landowners first buy and sell the land for self-use residential use, they must pay special attention to the date when completing the transfer registration of the re-purchased land. Moreover, the land being sold must meet the requirements for self-use residential land, meaning it should comply with the criteria of residential land that is already owned and used for self-use at the time of the land purchase.
The bureau provides further examples. Mr. A completed the transfer registration by purchasing self-use residential land on January 1, 2021. However, the sold land does not meet the requirements for holding self-use residential land at the time of purchase on January 1, 2021, as the landowner or their spouse, immediate family members, and others had moved into the household registration on October 1, 2022. As a result, the refund of land value-added tax for "repurchases self-use residential land" is not applicable.
