The creditor may investigate the debtor's property or income with the court's verdict confirmation but does not include the certificate of the house tax registration.

(Taichung) A citizen, Miss Chuang, recently said that she could apply to the local tax bureau for investigating the debtor's property or income with the court’s certificate to the effect that the judgment has become final and asked why she couldn’t check the debtor's tax registration proof of the building therewith.

The Local Tax Bureau of Taichung City Government said that the Tax Collection Act provided that creditors with an enforcement title might investigate the debtor's property income. The objective thereof is to assist creditors in receiving repayment for private debts as soon as possible. Therefore, if a creditor’s civil judgment has become finalized or the credit has obtained other legal titles for enforcement, it may submit an investigation request to the tax collection authority in regard to the debtor's property or income data . However, the said request is limited to those that can facilitate the enforcement, except for the tax registration proof of the building.

The bureau further explained that a ruling that had lost its enforcement title could not be used to apply for an investigation of the debtor's property. Therefore, for those who have obtained a ruling with an enforcement title should, within the validity thereof, apply for an investigation of the debtor's property or income data to ensure their rights and interests.
